Terms and Conditions for AIS Smart CAM Application (“T&C”)

Welcome to the registration of the AIS Smart CAM Application ("AIS Smart CAM"),
a application designed for the User's convenience to perform electronic transactions such as collecting, using, and disclosing information such as motion picture delivered from IP Camera and/or any Internet of Things (IoT) which User connects with AIS Smart CAM via your mobile application, and so on.

This Terms and Conditions for AIS Smart CAM Application (T&C) is made between the provider or developer of AIS Smart CAM (MIMO TECH COMPANY LIMITED "MMT") and you "User" and/or AIS Cloud IP Camera’s User whose service is provided by MMT’s Affiliates (“Affiliates”) and/or user of any service providers who connect their service system with AIS Smart CAM system.

1. Definitions

(1) Username means an alphabetical letter, figure, number, sound, or any other emblem of the User created in electronic form by the User and/or the system for the User to use to identify yourself when accessing to perform electronic transactions in the AIS Smart CAM.

(2) Password means alphabetical letter, figures, numbers, sound, or any other emblems of User created in electronic form by User and/or the system to use in collaboration with the Username of such User and to authenticate the electronic transactions performed in AIS Smart CAM that User has performed such transactions by yourself or has electronically initialed such electronic transactions.

2. When User downloads AIS Smart CAM’s mobile application and completes AIS Smart CAM's registration by following the steps specified by MMT, it implies that User accepts and will comply with this T&C, including any amended terms and conditions announced by MMT after the development and/or update of the application or AIS Smart CAM in the future.

3. User agrees and accepts that AIS Smart CAM shall be used together with AIS Cloud IP Camera provided by Affiliates or service providers who connect their service system to AIS Smart CAM.

4. User agrees and accepts that MMT has the right to suspend and/or terminate User’s AIS Smart CAM account at any time without prior notice to User.

5. AIS Smart CAM is controlled in Thailand. If User access AIS Smart CAM outside the Kingdom of Thailand, User agrees and consent to be governed by the laws of Thailand.

6. Information displayed on AIS Smart CAM, including trademarks, service marks, etc., are the intellectual property of MMT and MMT is authorized to use.

7. User confirms that, at the time of completing AIS Smart CAM’s registration, User is at least 18 years old, and that any information provided by User for registration, including any electronic transactions in AIS Smart CAM, is entirely genuine and can be used as evidence. If MMT discovers that such information is inaccurate, invalid, out of date, incomplete, or not your own, the User's AIS Smart CAM will be terminated immediately.

8. User agrees to use AIS Smart CAM only for the purpose of performing electronic transactions that User is authorized to perform and shall not perform in any unsuitable or illegal activity, or act against good moral, culture, and tradition, or act against the regulations, rules, or any orders that are currently applicable through AIS Smart CAM, any violation of which shall entitle MMT to immediately suspend use of AIS Smart CAM.

9. Any transaction performed by using Username/Password of User on AIS Smart CAM either by User or the authorized representative of User or the person granted by User to use your Username/Password or the person who falsely claims to use the Username/Password of User whether with intention or negligence of User shall be deemed that those transactions are complete and binding on User. If the mentioned transactions resulted in a service charge, fee, or cost, or caused damages, User, as the owner of the said Username/Password, shall be liable in all respects for any transaction.

10. User shall not transfer or sell the use of or the access to Username/Password on AIS Smart CAM. If it is known to User that there has been another person fraudulently using your Username/Password, User must immediately inform MMT to cancel such Username/Password.

11. Obligations and responsibilities of User:

(1) To acquaint with the method and process to access and to perform any transaction on AIS Smart CAM and strictly comply with this T&C including those to be adjusted and/or added in the future.

(2) To perform any transaction and obtain consent from all individuals for collecting, using, and disclosing any motion picture delivered by IP Camera and/or information delivered by any Internet of Things (IoT) that User, as the Data Controller shall strictly comply with the Personal Data Protection Act B.E. 2562 and related laws, connects with AIS Smart CAM.

(3) To cooperate with MMT or person authorized by MMT in order to protect AIS Smart CAM from damages.

(4) To immediately inform MMT of any improper use of or wrongful access to or interference with AIS Smart CAM.

(5) When using the mobile application to access AIS Smart CAM, the following practices must be complied:

(5.1) Set a password to lock the screen if not in use or doing other activities in order to prevent others from illegally accessing AIS Smart CAM

(5.2) Regularly inspect and take caution in inputting computer data to AIS Smart CAM and always update antivirus application in mobile phone

(5.3) Switch off the mobile phone and the peripheral equipment when not in use for long period of time

(5.4) Keep the password private and do not disclose it with anybody. Change the password if a dangerous event occurs, such as someone else knowing the password.

(6) To ensure and be responsible that your staffs, employees, agent, and persons under your responsibility shall not violate the following prohibitions. If such prohibitions are violated, User shall be jointly liable with the mentioned person for both civil and criminal offenses under applicable law:

(7.1) Change the computer data in AIS Smart CAM without the permission of MMT

(7.2) Fraudulently use of computer data in the AIS Smart CAM for disclosure and distribution to others, whether for personal interest or for others without permission. or cause MMT to be damaged

(7.3) Negligently or carelessly use AIS Smart CAM in such a way that causes other person being able to fraudulently disclose or distribute the computer data

(7.4) Use other person’s Password to access AIS Smart CAM to read, copy, change, delete or destroy the computer data or to perform any transaction either for personal or other person’s interest

(7.5) Harass or destroy the computer data in AIS Smart CAM in order to cause damages to MMT or to the others

(7.6) Fraudulently keep watching on, searching for or decoding the electronic data by using any equipment or technology to obtain the computer data in AIS Smart CAM or the confidential information of MMT or the others with intent to harm MMT or the others

(7.7) Assist or cooperate with the others to access AIS Smart CAM or the computer data to read, copy, change, delete or destroy the computer data or to perform any transaction either for personal or the others’ interest

(7.8) Fraudulently use the Password which is use for accessing AIS Smart CAM and cause damages to MMT or the others

(7.9) Negligently or carelessly use the Password or allow another person to use your own Password for access AIS Smart CAM

(7.10) Attempt to access the unauthorized part of AIS Smart CAM

(7.11) Install, having in possession of or use the hacking tools software

(7.12) Connect the computer equipment or any electronic device with AIS Smart CAM without permission of MMT

(7.13) Fraudulently access AIS Smart CAM in any wrongful manner

(7.14) Commit any offense as prescribed in the Computer Crime Act B.E.2550, the Personal Data Protection B.E 2562 and any other applicable laws

(7) User shall be responsible for the internet connection in order to access AIS Smart CAM according to this T&C at your own cost.

(8) User shall procure the necessary equipment for the internet connect with AIS Smart CAM such as a mobile phone with suitable qualification for AIS Smart CAM.

(9) User agrees and acknowledges that MMT shall not be, either directly or indirectly, liable for any loss or damage arisen from User’s use of AIS Smart CAM including any other damage such as the damage from the use or non-use of AIS Cloud IP Camera or any service that connect their service system to AIS Smart CAM, unless otherwise stated by applicable laws.

12. Should any of this T&C be considered invalid or unenforceable, it shall be deemed that those Terms and Conditions are void only to the extent of those being invalid or unenforceable without affecting the other Terms and Conditions which shall still be in full force and effect.

13. Notice: Any notice of the amendment, addition and/or cancellation of the T&C including any other information made by MMT either in form of a letter, a written document or computer data and/or sent to User via internet to the address given by User when having applied for the use of the service or the new address which User has notified to MMT not less than 15 days in advance or via AIS Smart CAM shall be deemed to have been duly made.

14. If User fails to comply with this T&C or Terms and Conditions for AIS Cloud IP Camera or other Terms and Conditions of any service connects to AIS Smart CAM, User consents MMT to suspend and/or terminate the use of AIS Smart CAM without prior notice to User.

15. In the event that User wishes to change, suspend, and/or cancel AIS Smart CAM and has complied with the process and method as prescribed by MMT. When MMT has completely changed, suspended, and/or canceled the use of AIS Smart CAM to User, it shall be deemed that all letters, documents and/or computer data which User sent to MMT for such purpose is an integral part of this T&C.

16. User understands and agrees that if this T&C, the Terms and Conditions for AIS Cloud IP Camera, or any other Terms and Conditions of any service connects to AIS Smart CAM are terminated for any reason, the User will no longer be able to use AIS Smart CAM for collecting, using, or disclosing motion pictures delivered from IP Camera or any information that User connects with AIS Smart CAM.

17. If User take any action that caused damage to AIS Smart CAM, MMT or anyone through AIS Smart CAM, User will be liable for both civil and criminal offence.

 

Terms for Collect, Use and Disclose Personal Data for privileges of User

By accepting this T&C, User allows MMT to collect, use, and disclose ‘personal data’ for the User's benefit in accordance with the ADVANCED INFO SERVICE PUBLIC COMPANY LIMITED and its affiliates' Notice of Personal Data Protection and all the applicable laws.

1. "Personal Data" means the User's name, surname, address, financial information, transaction information, health information, biometrical information (such as fingerprints, face), physical disability, and/or any other information which can directly or indirectly identify the User or may identify the User and has been provided to MMT by the User or another source.

2. MMT collects, uses or discloses personal data for the purpose of providing services that User have registered including services or activities that interest User, such as telecommunication services, broadcasting services, payment service, digital service or any other service or for the purpose of creating a database and using information to offer benefits according to User’s interests or to provide after-sales service or to comply with the current and future laws or regulations applicable to MMT. To provide such services, MMT is required to send, transfer, and/or disclose personal data to the recipients, which are companies in the group, business partners, organizations, or juristic persons whom MMT is a contracting party or has a legal relationship with; thus, the User consents MMT to send, transfer, and/or disclose such information both domestically and internationally in countries with adequate personal data protection standards, and MMT shall collect the personal data only for as long as necessary for those purposes. Furthermore, the recipients are also legally required to protect personal data. If the objective of collecting personal data changes in the future, MMT shall notify User.

3. User or data subject has the right to revoke their personal data consent at any time, unless doing so has a significant impact on the provision of services, or beyond MMT's control, or is restricted by law. 

4. The consent for the collection, use, and disclosure of personal data is valid for the period specified by law.

5. User' or data subject' rights regarding revocation, requesting access to and obtaining a copy of personal data, objecting to collection, use, or disclosure, requesting relocation, deletion, or destruction, and suspending use of personal data shall be in accordance with The Notice of Personal Data Protection of AWN and its affiliates, along with all applicable laws.
